Terms of Service

1. Agreement to Terms

By accessing and using the Simply Proxies service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

The Service is operated by Hunt-Benito Ltd. (registered in Scotland, United Kingdom No. SC728400) ("Company", "we", "us", "our") with VAT No. GB435392292.

2. Description of Service

Simply Proxies provides mobile proxy services. The Service allows you to:

  • Create an account and generate proxy credentials
  • Purchase credits that act as a prepaid balance redeemable for our services (currently proxy traffic)
  • Use proxy credentials to route internet traffic through our proxy network

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to use this Service. By registering, you represent that you are at least 18 years of age.

3.2 Account Security

  • You must provide a valid email address and create a strong password.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You are liable for all activities that occur under your account.

3.3 Account Verification

We may require email verification before granting full access to the Service. We reserve the right to suspend or terminate accounts with unverified email addresses.

4. Credits and Payment

4.1 Credit Purchases

  • Credits are a prepaid balance with no cash value, redeemable only for services provided by us. They are not money, cannot be withdrawn or transferred to another person, and (except for your statutory cancellation rights in section 4.5) are non-refundable.
  • The current price per credit and the services each credit provides are displayed on the Billing page.
  • Credits are sold in the quantities specified on the Billing page, subject to a minimum purchase.
  • All prices are displayed in GBP. Credits are sold as a VAT-inclusive prepaid balance (see section 4.3 for how VAT is accounted for).

4.2 Payment Processing

  • Payments are processed securely through Stripe. We do not store your card details.
  • By making a purchase, you authorize us to charge your payment method for the selected amount.
  • All transactions are in GBP (British Pounds Sterling).

4.3 VAT and Invoices

  • Credits are sold as a prepayment for our services. As a UK-registered company, we charge VAT at the prevailing rate (currently 20%) at the time of purchase for UK customers. The price you see is the price you pay — applicable VAT is included.
  • VAT is calculated automatically at checkout based on the country associated with your payment method.
  • VAT-compliant invoices are available for download from the Billing page for each completed purchase.
  • For consumers outside the UK, VAT or equivalent tax depends on your country and may be charged at checkout; business customers outside the UK with a valid VAT or registration number may qualify for reverse-charge or outside-scope treatment — contact us for details.
  • For VAT inquiries, contact us using the details on the Billing page.

4.4 Credit Expiry and Refunds

  • Credits do not expire and remain on your account until redeemed.
  • No cash value. Credits are not money and have no cash value. They may be redeemed only for services we provide and may not be withdrawn, transferred, or exchanged for cash.
  • Refund Policy: Other than your 14-day cancellation right on unredeemed credits (section 4.5), credits are non-refundable. We will, however, consider a refund in the following circumstances:
    • The Service is materially different from what was described.
    • We are unable to provide the Service due to a fault on our end.
    • You are entitled to a remedy under the Consumer Rights Act 2015.
  • To request a refund, contact support with your account email and transaction details.
  • Approved refunds will be issued to your original payment method within 14 days.

4.5 14-Day Cancellation Right

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel a distance contract from the day you purchase credits.

If you cancel within that 14-day period, we will refund the value of any unredeemed credits, less the value of any services we performed at your request during that period (for example, proxy traffic you used). Credits you have already redeemed for services are not refundable.

To exercise this right, contact support using the details on the Billing page with your account email and transaction details. Refunds of unredeemed credits will be issued to your original payment method within 14 days of your cancellation request.

Nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 if a service is not provided with reasonable care and skill.

5. Acceptable Use

5.1 Permitted Use

You may use the Service for lawful purposes only, including but not limited to:

  • Web scraping of publicly available data
  • SEO monitoring and research
  • Brand protection and ad verification
  • Market research and price comparison
  • Accessing geo-restricted content where legally permitted

5.2 Prohibited Use

You must NOT use the Service to:

  • Engage in any illegal activity
  • Distribute malware, spam, or malicious content
  • Attack, hack, or gain unauthorized access to any system
  • Violate the intellectual property rights of others
  • Distribute child exploitation material
  • Facilitate fraud, phishing, or social engineering attacks
  • Attempt to overwhelm or disrupt the Service or its infrastructure

5.3 Abuse Reporting

If you become aware of any misuse of the Service, please report it to: abuse@simplyproxies.com

We investigate all reports and will take appropriate action, including account termination and reporting to law enforcement where necessary.

5.4 Consequences of Misuse

We reserve the right to:

  • Suspend or terminate your account without notice
  • Revoke unused credits (subject to section 4.5)
  • Report illegal activity to relevant authorities
  • Block specific traffic patterns that violate these Terms

6. Service Availability

6.1 Uptime

We strive to maintain high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where possible)
  • Emergency maintenance
  • Circumstances beyond our control (force majeure)

6.2 Data Allowance

  • Your credit balance is reduced as you use the proxy service, at the rate displayed on the Billing page.
  • Traffic is measured to the nearest whole megabyte.
  • Unused credits remain on your account and do not expire.

7. Intellectual Property

7.1 Our Rights

All content, software, and materials associated with the Service are owned by or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.

7.2 Copyright Infringement Notices

We respect intellectual property rights. If you believe that your copyrighted work has been used via our Service in a way that constitutes copyright infringement, please send a notice to our designated contact:

Your notice must include:

  • A description of the copyrighted work you claim has been infringed
  • A description of where the allegedly infringing material is located
  • Your contact information (address, telephone number, and email)
  • A statement that you have a good-faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

We will respond to valid notices in accordance with applicable UK law, including the Copyright, Designs and Patents Act 1988.

8. Limitation of Liability

8.1 To the fullest extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, either express or implied.
  • We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8.2 Maximum Liability

Our total liability to you shall not exceed the total amount you have paid for credits in the 12 months preceding the claim.

8.3 Statutory Rights

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your rights under the Consumer Rights Act 2015.

9. Data Protection and Retention

Your personal data is processed in accordance with our Privacy Policy. Key points:

  • We collect only the minimum data necessary to provide the Service (email address, usage data).
  • Payment data is processed by Stripe and never stored on our servers.
  • You have the right to access, correct, delete, and port your data (see Account Settings).
  • We do not sell your personal data to third parties.
  • We do not log, inspect, or store the content of traffic routed through our proxy network.

9.1 Data Retention Periods

We retain personal data only as long as necessary:

9.2 Your Rights (UK GDPR)

You have the right to:

  • Access your data (download from Account Settings)
  • Rectification of inaccurate data
  • Erasure ("right to be forgotten") subject to legal retention obligations
  • Data portability (machine-readable format available from Account Settings)
  • Object to processing or request restriction

10. Termination

10.1 By You

You may close your account at any time through the Account settings page. Unused credits are non-refundable after the 14-day cancellation period in section 4.5; any unredeemed credits within that period may be refunded in accordance with section 4.5.

10.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraudulent or unauthorized activity
  • Required by law or legal process
  • The Service is being discontinued

We will provide reasonable notice where possible, except in cases of serious violation.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page with a new "Last updated" date
  • Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.
